Tackling unfair leasehold practices

The government has published a consultation paper, ‘Tackling unfair practices in the leasehold market’, seeking views on, among other things, its proposals to end the use of leasehold tenure for new build houses.  Leaseholders, whether you live in a house or a flat, are encouraged to respond. The consultation closes on 19th September and responses can be submitted through an online survey.

The consultation, issued in July, follows hard on the heels of the  Housing White PaperFixing our broken housing market’ published in February 2017. The White Paper highlighted the government’s aim to improve consumer choice and fairness in the leasehold sector.

This consultation looks at a range of measures to tackle unfair and unreasonable abuses of leasehold, with a particular focus on the sale of new leasehold houses and onerous ground rents. However, it is also part of a wider agenda to look at other issues such as

  • improving commonhold
  • how managing agents operate
  • leasehold terms and enfranchisement

Indeed, the consultation specifically asks respondents What further areas of leasehold reform should be prioritised for reform and why?
